Terms & Conditions
Effective date: 15 June 2025. These terms govern use of the Visual Factories website and platform provided by Visual Factories Ltd.
Acceptance
By accessing this website or using the Visual Factories platform you agree to these terms. If you are entering into them on behalf of an organisation, you confirm you have authority to bind that organisation.
Service and licence
Subject to these terms and any signed order, we grant you a non-exclusive, non-transferable right to access the platform for your internal manufacturing operations for the duration of your subscription.
Acceptable use
- Do not reverse engineer, copy or resell the platform or any part of it.
- Do not attempt to gain unauthorised access to systems or other customers' data.
- Do not use the service unlawfully or in a way that disrupts its operation.
- You are responsible for the security of your account credentials.
Hardware and installation
Where sensors, gateways or other hardware are supplied, they remain subject to the terms of the applicable order. You are responsible for providing safe access, power and network connectivity at your site.
Customer data
Production data collected from your machines remains yours. We process it to deliver the service and may use aggregated, de-identified data to improve the platform. Our handling of personal data is described in the Privacy Policy.
Intellectual property
The platform, website, software, documentation and all related intellectual property remain the property of Visual Factories Ltd. and its licensors. No rights are granted other than those expressly stated here.
Fees
Fees, billing frequency and term are set out in the applicable order. Unless stated otherwise, fees are exclusive of taxes and are non-refundable once the relevant period has begun.
Availability and support
We work to keep the service available and supported, but access may be interrupted for maintenance, updates or causes outside our reasonable control.
Warranties and liability
Except as expressly stated, the service is provided "as is" without further warranty. To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential loss, loss of profit or loss of production, and our aggregate liability is limited to the fees paid in the twelve months preceding the claim.
Termination
Either party may terminate for material breach that remains uncured after written notice. On termination your access ends and outstanding fees become payable.
Changes
We may update these terms; continued use after an update constitutes acceptance of the revised terms.
